Terms of Service
Agreement - River City Online is an online service provider for access onto the Internet. This agreement sets forth the Account terms and Conditions which apply to the subscriber for use of River City Online. The subscriber is deemed to have agreed to comply with all terms by use of the service.
Billing Period - All services provided by River City Online will be billed in advance for the forthcoming month. If a customer utilizes a service, through River City Online, with any additional hourly charges or single-use special charges, these charges will be billed at the time of the next months billing. Credit card authorized payment will also be billed in the same manner. River City Online reserves the right to terminate or discontinue service at any time.
Billing Terms - You will be billed every month for service, unless you explicitly close your account. If you choose to pay by credit card, you authorize River City Online to bill these charges to your card. You specifically agree to pay these charges each month and further agree that failure to pay these charges is grounds for termination all services. Accounts are paid via Bank Draft, auto debit, or Major credit card. Any accounts past due are subject to a $10 late fee. Accounts 10 days or more past due will have their passwords disabled. Accounts more than 30 days past due are deleted and are subject to a $25 re-connect fee.
Software - River City Online will provide one services CD or software set. Additional software will be provided at $15 per set. Software provided is on an as-is basis. River City Online makes no express or implied warranty (including those of merchantability or fitness for a particular purpose) with respect to the Software provided.
Cancellation Policy - On cancellation; accounts will be billed to the end of the present month. If the subscriber has prepaid beyond the current month then the remainder beyond that month will be refunded.
Legality of Content - The subscriber agrees to use River City Online for lawful purposes only. The subscriber will not post or transmit any material, through River City Online, which violates or infringes upon the rights of other users. This includes, but is not limited to: threatening, abusive, defamatory, vulgar or obscene language, any action which threatens public or private rights or which is considered objectionable, any action which encourages a criminal offense, any action which gives rise to civil liability or violates any law. Attempts to gain unauthorized access to outside computer systems are expressly prohibited. Users agree to abide by any and all rules of the network they access through River City Online. The subscriber agrees to defend and hold harmless River City Online, its directors, officers, employees, agents or might arise from the subscribers use or misuse of the service, which damages or otherwise harms either the subscriber, River City Online or a third party.
Time Limits - River City Online customers may not leave their dial-up accounts connected for more than 24 hours at a time. This constitutes "nailing-up an account". Your personal account is intended for unlimited personal use: meaning, (and our definition is final) that you may have your connection up as long as you are personally in front of your PC. Your personal account is not a dedicated account. If you disregard this policy and leave your account up for more than 24 hours, your account will be terminated.
Inactivity Disconnect Policy - River City Online reserves the right to disconnect a dial-up account after 15 minutes of inactivity, as detected by River City Online through electronic means. The time is approximate and subject to change without notice at River City Online's sole discretion. Electronic or mechanical means to avoid an inactivity disconnect are strictly prohibited. Electronic or mechanical means include, but are not limited to; "pinging" the mail server, employing electronic or software autodialer features to maintain an active connection or repeatedly checking for e-mail by autologin to the mail server. River City Online reserves the right to electronically audit connections to enforce the above requirements.
Multiple Logins - Only one person, the subscriber, may use the PPP account. Multiple or simultaneous logins will constitute forfeiture of the account and your account will be terminated.
Responsibilities - River City Online will make reasonable efforts to provide continuous, uninterrupted, expedient and error-free Service to you. River City Online makes no warranties, express or implied, regarding services provided. River City Online also disclaims any warranty of merchantability or fitness for any particular purpose. River City Online is not responsible for any damages suffered from the use of our services, including but not limited to, loss from computer viruses, loss of data, service interruptions and/or delays, or third party litigation.
Content Screening - River City Online cannot and does not control the content of information available over the Internet. For this reason, the subscriber certifies that he/she is at least 18 years of age or, if the subscriber is a parent or guardian, he/she assumes all responsibility for supervising the online activities of the underage user. Any information garnered through River City Online is done at your own risk.
Unauthorized Connections - The subscriber shall not allow unauthorized connections to River City Online, unauthorized reselling of River City Online, or the solicitation of River City Online users to become subscribers to other online service providers in competition with River City Online. No subscriber shall make any unauthorized copies or duplication of any River City Online material, advertising, forms, brochures, pamphlets and the like which is the property of River City Online.
SPAM Policy - The transmission of any type of material, whether graphical or textual in context, to other subscribers or non-subscribers without their express consent is prohibited under the terms of this agreement. Any violations of our SPAM policy will result in immediate termination. Any complaints from our subscribers or non-subscribers of unsolicited materials will result in a charge of $150.00 per complaint charges to the offending subscribers account automatically.
Unauthorized use of River City Online Equipment - Any subscriber attempting to attack River City Online Equipment in any way will be billed at $250.00 per hour, with a minimum billable time period of 1 hour, to track the offending subscriber and repair any damage they may have caused.
Home Pages - River City Online hosting services may only be used for lawful purposes. Transmission of any material in violation of any U.S. or any State's regulations is prohibited. This includes but is limited to: copyrighted material, material legally judged to be threatening or obscene, material protected by trade secret, or in any way a violation of intellectual property laws. Client specifically agrees not to upload, post or reproduce in any way materials protected by copyright laws without the permission of the copyright holder. Sites containing Adult-oriented material, sites encouraging illegal activity or racism, sites including hacking/phreaking, piracy, or any other sites the administrators deem inappropriate will not be allowed on River City Online. Please note that any use of our system to engage in software piracy or similar violations will result in account suspension and immediate report to the FBI, SPA, and appropriate local authorities.
Modification of Terms - River City Online reserves the right to change or modify the terms, conditions, rates or services at any time, without prior notification.
